CAN THE POLICE CONDUCT A SEARCH WITHOUT A WARRANT IN FLORIDA?


This is a really good question, and it's one not easily answered off the cuff. However, usually in Florida, there's only a few limited exceptions in which law enforcement can conduct a warrantless search. That would not be with your home. Warrantless searches are more in terms of automobile searches. So, if law enforcement develops probable cause, and because of the fact that your automobile is easily movable and they feel that there is evidence in that vehicle that they need to recover, there are certain exceptions that they're able to conduct a warrantless search.
